New York Pedestrian Crashes
Most of the time, pedestrian crashes end in severe injuries for pedestrians themselves. This is mostly due to the fact that pedestrians are often traveling with virtually no protection against the force of fast-moving, heavy vehicles. When pedestrians are hit by cars, trucks, or other vehicles, they usually have to go to the hospital where they must stay for prolonged periods of times. While there, they have to undergo medical care that is expensive, invasive, and overwhelming.
Being seriously hurt in a pedestrian crash is usually an extremely difficult experience. Unfortunately, the majority of these crashes are caused by drivers who are distracted, intoxicated, speeding, or fatigued. Negligent driving has become a severe issue in the United States, causing over 93% of reported accidents every year. When we consider that more than 6 million crashes happen yearly, it is alarming to think that millions and millions of accidents happen due to the actions of negligent drivers. Sadly, around 3 million people are hurt per year in these crashes while over 40,000 end up losing their lives.
With the help of a pedestrian accident attorney, an injured pedestrian can collect financial compensation for all of the damages they have suffered due to their recent accident. Some of these damages may include:
- lost wages
- medical care costs
- costs related to vehicle repairs
- emotional turmoil
- pain
- suffering
In New York, pedestrians legally have the right of way at intersections and crosswalks. This indicates that, by law, drivers need to yield until they completely exit the roadway. If a crash happens between a pedestrian and a driver, the law also states that the motorist most likely violated their duty of care, despite whether the crash occurred inside or outside of a crosswalk.
However, pedestrians also owe drivers certain duties of care, such as always making sure vehicles are not headed toward them and crossing at specified crosswalks.
