Who Can File a Wrongful Death Claim in Hazlet, NJ?
In Hazlet and throughout New Jersey, a wrongful death claim must be filed by the personal representative of the deceased person’s estate. This is typically someone named in a will or appointed by the court.
The personal representative files the claim on behalf of the people who suffered losses from the death. Those beneficiaries are usually immediate family members, such as a spouse, children, or parents. The compensation recovered is distributed among eligible survivors based on their relationship to the deceased.
Immediate family members are generally the first in line to receive any recovery. A surviving spouse, children, and dependent parents are typically considered primary beneficiaries under New Jersey law. Their financial and emotional dependence on the deceased often determines how damages are distributed.
Extended family members, such as siblings, may qualify in some situations. Eligibility depends on whether they relied on the deceased for financial support. Each case is evaluated based on the specific circumstances of the family.
Dependency plays a significant role in determining who qualifies. If a family member depended on the deceased for income, housing, or daily support, they may have a stronger basis for inclusion. A lawyer can help evaluate whether your situation meets the legal threshold.
New Jersey wrongful death claims must generally be filed within two years of the date of death. Missing this deadline can prevent eligible family members from recovering anything. Acting promptly gives an attorney time to gather evidence and build a proper case.
A wrongful death lawyer can review your situation and determine who is eligible to file and recover compensation. They can also handle the legal process and gather the evidence needed to support the claim.
