Legal Options for Injured Passengers After a Car Accident in New Jersey
In New Jersey, an injured passenger generally has the right to pursue a compensation claim regardless of who caused the accident. If the driver lost control due to negligence the passenger may be able to file a claim against that driver’s insurance. Depending on the circumstances, other parties may also share liability.
Passengers are often in a particularly vulnerable position during serious crashes. In rollover accidents, ejection injuries tend to be severe and can include spinal damage, traumatic brain injuries, and broken bones. Recovery from this type of injury can be lengthy and may require ongoing medical treatment, rehabilitation, or long-term care.
New Jersey’s no-fault insurance system requires drivers to carry Personal Injury Protection coverage, which can help pay for initial medical expenses regardless of fault. However, when injuries are serious a person may be able to step outside the no-fault system and pursue a claim directly against the at-fault party. An attorney can help determine which path applies based on the details of the case.
A car accident lawyer can review the facts of a passenger injury case and explain what options may be available. This includes identifying applicable insurance coverage, gathering evidence, and clarifying what types of compensation a person can be eligible to seek, such as medical bills, lost wages, and costs related to long-term recovery. Legal guidance can make a significant difference when injuries are serious and medical expenses are high.
