Who Is Liable if a Minor Is Hit by a Vehicle in New Jersey?15-Year-Old Pedestrian Hurt in Crash on Church St

In New Jersey, liability in a pedestrian accident involving a minor depends on the specific circumstances of the crash. In many cases, the driver of the vehicle may be held responsible if negligence — such as speeding, distracted driving, or failing to yield — contributed to the accident. However, liability is not always straightforward and may involve multiple parties depending on where and how the collision occurred.

New Jersey follows a modified comparative negligence rule. This means that more than one party can share responsibility for an accident. When the victim is a minor, courts generally apply a higher standard of care to drivers in areas where children are likely to be present, such as residential streets and school zones.

Injuries in pedestrian accidents involving minors can be serious. Children are more physically vulnerable than adults, which means the same impact can cause greater harm. Common injuries include broken bones, head injuries, and internal trauma. Some effects may not appear immediately, making early medical evaluation especially important for younger victims.

A pedestrian accident lawyer can review the details of a case involving an injured minor and explain what legal options may be available. In New Jersey, a parent or guardian may be able to pursue a claim on behalf of the child. An attorney can help identify who may be liable, what documentation is needed, and what types of compensation a person can be eligible to seek, including medical costs and long-term care expenses.
