Can Pedestrians File a Personal Injury Claim After a Truck Crash in Jersey City, NJ?Woman, Two Children Hurt After 18-Wheeler Hits Them in Jersey City, NJ

Yes, pedestrians hurt by a commercial truck in New Jersey can pursue a personal injury claim against the at-fault driver and, in many cases, the trucking company as well. When a tractor-trailer is involved, liability may extend beyond the individual driver to include the company that owns or operates the vehicle.

Pedestrian crashes that involve large commercial trucks are among the most serious on the road. Jersey City sits at the intersection of several heavily trafficked corridors, such as US-1/9 through the Tonnelle Ave stretch, all of which see significant truck traffic daily. Crossings near schools, transit hubs, and mixed-use neighborhoods carry added risk when large vehicles fail to yield.

People hurt in a pedestrian accident may face serious physical consequences such as traumatic brain injuries, broken bones, internal injuries, and long recovery periods. Children are especially vulnerable in high-impact crashes involving heavy vehicles. Medical costs, missed school, and a parent's lost time from work can all add up quickly

New Jersey follows comparative fault rules, which means that even if a pedestrian is found partially at fault, they may still be eligible to seek compensation depending on the circumstances. A pedestrian accident attorney can help identify who may be held responsible and what documentation is needed to support a claim. In New Jersey, the statute of limitations for personal injury cases is generally two years from the date of the accident, so to act within that window matters.
