What Legal Options Do Families Have After a Fatal Workplace Accident in Woodland Park, NJ?
In New Jersey, families who lose a loved one in a fatal workplace accident in Woodland Park may have legal options available to them, including workers’ compensation death benefits and, in some cases, a personal injury lawsuit against a third party. The former covers funeral expenses and a portion of the deceased worker’s wages for dependents.
When a third party, such as a contractor, equipment manufacturer, or property owner, contributed to the accident, families may be able to file a separate civil claim outside of the workers’ compensation system.
This type of claim can allow for a broader range of compensation than workers’ comp alone provides. A wrongful death attorney can review the details of the crash to determine whether a third-party claim applies.
Wrongful death claims in New Jersey must generally be filed within two years of the date of death. These claims can seek compensation for medical expenses incurred before death, lost future income, and the loss of companionship and household contributions.
