How Can Workers Pursue Compensation After a Fall in Montvale, NJ?

Worker Injured in Roof Fall at Sharp Electronics Complex

A worker injured on the job in New Jersey may generally seek workers' compensation benefits for a compensable work-related injury. Those benefits can cover medical treatment and certain wage-related losses, while a separate claim may sometimes be possible against a third party whose negligence contributed to the injury.

New Jersey law generally limits lawsuits against an employer when workers' compensation applies, which makes the identity and role of other potentially responsible parties important.

Falls from elevated surfaces can result in serious injuries involving the hips, legs, back, head, or other parts of the body. OSHA states that construction employers generally must provide fall protection at elevations of six feet or more, including guardrails, safety nets, or personal fall arrest systems where applicable.

For a worker at a commercial property, determining who controlled the worksite and which company employed the worker can be significant. A workers’ compensation lawyer can review employment records, safety documentation, medical records, and information about contractors or property owners to determine whether a third-party claim may exist.

At Metro Law, we know the challenges that workers face after being injured on duty. If you have been injured, we can explain to you how workers' compensation may apply to your case.
