What Legal Options Do Families Have After a Fatal Crash in Rockland County, NY?1 Killed, 2 Hurt in Overnight Crash on I-287 in Rockland Co., NY

When someone is killed in a highway crash in New York, their surviving family members may have the right to file a wrongful death claim against any party whose negligence contributed to the fatality. Under New York law, eligible family members can include a spouse, children, or parents of the deceased. These claims are separate from any criminal proceedings and focus specifically on the financial and personal losses the family has suffered as a result of the death.

Rockland County's major highway corridors carry heavy traffic at all hours. Late-night crashes on these roads can involve factors such as fatigue, impairment, or excessive speed, any of which may establish grounds for a civil claim. To identify what caused a fatal crash, and who bears responsibility, is usually the first step in determining whether a wrongful death case can move forward.

The losses that follow a fatal accident can extend well beyond funeral and burial costs. Families may also be entitled to seek compensation for lost financial support, loss of companionship, and the pain and suffering experienced by the deceased prior to death.

New York wrongful death law places the filing deadline, which is known as the statute of limitations, at two years from the date of death, so timely legal consultation matters. A wrongful death attorney can help grieving families understand what options may realistically be available to them and what the process looks like from start to finish.
