Children's Legal Options After Being Involved in a Wreck in Elk Twp., NJ

One Killed, Child Injured in Rollover on Route 55

When a child is harmed in a crash, families in Elk Township usually want to know how the law treats a minor's claim differently from an adult's. In New Jersey, the statute of limitations for a personal injury claim is generally tolled until a minor turns 18, giving them two years from that birthday to file, though a parent may separately pursue a claim for the child's medical expenses sooner.

Children involved in a rollover or similar wreck can face fractures, head trauma, or lingering emotional effects that take time to fully appear. Recovery can mean missed school, physical therapy, and ongoing medical visits, and families sometimes deal with these needs for months after the initial hospital stay.

Because a settlement that involves a minor typically requires court approval in New Jersey, a car accident lawyer can help guide a family through that process and explain how a claim on a child's behalf might be structured. Legal guidance can also help clarify what types of compensation may be available to help with a child's medical costs, though outcomes vary case by case.

At Metro Law, we can review the facts of a child's case and go over what legal steps may make sense for your family. Every situation is different, and a straightforward conversation can help you understand what to expect.
