Determining if the driver of a car involved in a pedestrian accident was negligent depends on multiple factors. The pedestrian might have been walking, standing, or jogging when they were injured, but this is not enough to show that a driver acted negligently and, therefore, is liable for the resulting injuries.

A pedestrian could have been inside or outside of a crosswalk when the accident occurred, but, again, this fact alone will not prove if and to what degree the driver was negligent. Where pedestrian accidents are concerned, the determination of negligence demands careful study, critique, and presentation of all factors that played a role in the incident.

A skilled New York pedestrian accident lawyer must then explain the facts to a jury, showing that the driver of the car failed to exercise reasonable care. Learning all events surrounding the accident is crucial to both attorneys and insurance adjustors in establishing the negligence of a driver and moving forward with your New York personal injury claim.

Pedestrian accident attorneys need to have experience and legal proficiency if they hope to garner the maximum settlement or favorable verdict on behalf of their clients.
