Pedestrian Fatalities in Elmira

Elmira, NY - Fatal Pedestrian Accident on Clemens Center Parkway Bridge

Deciding if the driver involved in a pedestrian accident was negligent hinges on several factors. The pedestrian could have been walking, jogging, or standing when they were hit, but this is not enough to prove that a driver acted negligently and, therefore, is responsible for the resulting injuries.

A pedestrian may have been outside or inside of a marked or unmarked crosswalk when the accident occurred, but, again, this alone will not establish if and to what degree the driver was negligent. Where pedestrian accidents are concerned, the determination of negligence demands careful study, critique, and presentation of all factors that played a role in the incident.

An experienced New York pedestrian accident attorney must explain the facts to a jury, proving that the driver of the car failed to exercise reasonable care. Learning all events surrounding the accident is crucial to both attorneys and insurance adjustors in establishing the negligence of a driver and moving forward with your New York personal injury claim.

Pedestrian accident attorneys should have experience and legal proficiency if they hope to garner the maximum settlement or favorable verdict on behalf of their clients.
