Aberdeen, NJ (June 1, 2026) – A 38-year-old man was struck and killed Saturday night, May 30, while carrying his 4-year-old son across Route 35 in Aberdeen. The father and son were in the crosswalk, crossing from west to east, when a 2015 Nissan Frontier traveling south in the left lane hit them. The Nissan’s driver stayed at the scene. No charges or summonses had been filed at the time of this report. The identities of those involved had not been publicly released.
The Monmouth County Prosecutor’s Office continues to investigate the accident.
We extend our heartfelt condolences to this family and to all who loved the man who lost his life.
What Rights Does a Pedestrian’s Family Have After a Fatal Accident in Aberdeen, NJ?
When a pedestrian is killed in a crosswalk crash in New Jersey, the victim’s family may be eligible to file a wrongful death claim against the at-fault driver. Under New Jersey law, drivers are required to yield to pedestrians in crosswalks, and a failure to do so can form the basis of a civil claim. Surviving family members could be able to seek compensation for funeral costs, lost income, and the loss of parental guidance and companionship. New Jersey’s wrongful death statute also allows claims on behalf of minor children who have lost a parent.
After a fatal accident, a wrongful death attorney can help the family understand what evidence may be relevant. Crucial evidence can include dashcam footage, witness accounts or the official crash report.
If a child is hurt in an accident, they may have legal ground to seek compensation. In these cases, a child may have the possibility of pursuing a separate claim for their injuries and losses. Legal counsel can help protect the interests of the minor.
