Legal Rights After a Fatal Hit-and-Run Crash in New JerseyPedestrian Killed in Fatal Hit-and-Run at Essex St & Summit Ave

Families who lose a loved one in a hit-and-run crash in New Jersey have legal rights, even when the driver has not yet been identified. New Jersey law allows surviving family members to pursue a wrongful death claim once the at-fault driver is found. In cases where the driver remains unidentified, compensation may still be available through uninsured motorist coverage under the victim’s own auto insurance policy or that of a household family member.

Hit-and-run crashes that result in death are treated seriously under New Jersey law. A driver who leaves the scene of a fatal accident can face criminal charges. These criminal proceedings run separately from any civil claim a family may choose to pursue for financial losses related to the death.

Families dealing with the loss of a loved one in this type of crash may face unexpected expenses, including funeral costs, medical bills incurred before death, and the long-term financial impact of losing a family member’s income and support. A wrongful death claim can potentially address these losses. An attorney can review what documentation exists, explain how New Jersey’s wrongful death statute applies, and clarify what a family may be eligible to seek.

Working with a wrongful death lawyer in hit-and-run cases can also help families stay informed as the investigation unfolds. An attorney can monitor case developments, communicate with investigators when appropriate, and advise on how new information may affect civil options. Legal guidance early in the process helps ensure that important deadlines and documentation requirements are not missed.
