Who Pays for Medical Bills After a Car Accident in Staten Island, NY?Person Hurt in Crash on Staten Island Expy Near Clove Rd, NY

In New York, medical bills after a car accident are typically covered first through no-fault insurance, also called Personal Injury Protection. No-fault coverage applies regardless of who caused the collision and can pay for medical treatment, a portion of lost wages, and other out-of-pocket costs up to the policy limit.

This system is designed to get injured people access to care quickly, without waiting for fault to be established. However, when injuries are serious, no-fault coverage may not be enough to cover the full cost of treatment.

When medical costs exceed no-fault limits, or when injuries meet New York’s serious injury threshold, a person could be eligible to file a claim against the at-fault driver for additional compensation. Serious injuries under New York law include fractures, significant disfigurement, and conditions that prevent a person from carrying out normal daily activities for a defined period. A car accident attorney can help determine whether your injuries qualify and what additional options may be available.

In New York, the statute of limitations for a personal injury claim is generally three years from the date of the accident. Victims that miss that deadline typically means losing the right to seek compensation through the courts, regardless of how strong the case may be. It is worth to note that claims that involve government-owned vehicles or roadway defects can carry much shorter notice deadlines, sometimes as little as 90 days, so early legal guidance can make a significant difference.
