How Long Do I Have to File a Car Accident Claim in New Jersey?Update: Man Killed in Four-Car Crash on Rte 80

In New Jersey, most people have two years from the date of a car accident to file a personal injury lawsuit. This deadline is set by the state’s statute of limitations. Missing this window can prevent a person from pursuing legal action, regardless of the circumstances of the crash.

For wrongful death claims, the two-year period generally begins on the date of the victim’s death. Family members or legal representatives of the deceased may be eligible to file a claim seeking compensation for losses related to the death. Acting within this timeframe is important to preserve available legal options.

There are some exceptions that can affect the deadline. In certain cases involving government vehicles or roadway conditions, notice of a claim may need to be filed much sooner, sometimes within 90 days. An attorney can review the specific details of a collision and clarify which deadlines apply.

Waiting too long can also affect the strength of a case. Evidence can become harder to collect, witnesses may be more difficult to locate, and documentation can be lost over time. Speaking with a car accident lawyer soon after an accident helps ensure that important information is gathered and preserved early.
