Who Pays for Medical Bills After a Car Accident in New Jersey?
In New Jersey, your own car insurance typically pays for medical bills after a crash, regardless of who caused the accident. This is because New Jersey is a no-fault insurance state. Under this system, drivers are required to carry Personal Injury Protection (PIP) coverage, which covers medical expenses after a collision up to the policy limit.
PIP coverage applies to the policyholder and, in most cases, passengers in the vehicle. It covers a range of medical costs, including emergency room visits, hospital stays, follow-up appointments, and rehabilitation. The amount covered depends on the policy selected, so limits can vary from person to person.
When medical bills exceed PIP limits, other options may become available. In some cases, a person may be able to pursue a claim against the at-fault driver, depending on the type of policy they hold. New Jersey drivers choose between a “limited right to sue” and an “unlimited right to sue” option when purchasing their policy, and this choice can affect what steps are available after a serious injury crash.
Health insurance may also help cover costs that PIP does not. Keeping organized records of all medical visits, bills, and treatments helps make this process easier to manage. A car accident lawyer can review these documents and explain what additional options may apply to a specific situation.
