Can a Family File a Wrongful Death Claim After a Motorcycle Accident in Tully, NY?

Motorcyclist Killed in Crash on Rte 281

Yes, under New York law, the family of a motorcyclist killed in an accident can pursue a wrongful death claim against the driver responsible, typically through a court-appointed representative of the estate.

Families dealing with the sudden loss of a loved one in a motorcycle collision commonly face funeral costs, lost income, and the emotional toll of losing companionship and support. These losses are separate from any medical bills incurred before death and can be significant depending on the circumstances.

In these cases, a wrongful death lawyer can help families understand whether a left-turning driver failed to yield the right of way, which is a common factor in motorcycle collisions at intersections.

New York follows a pure comparative negligence rule, that means that a family can recover damages even if the motorcyclist is found partially at fault, though any recovery would be reduced by that percentage. Wrongful death claims in New York generally must be filed within two years of the date of death.

Losing a family member suddenly raises difficult questions about what comes next. At Metro Law, we can help explain the general process for families dealing with the aftermath of a fatal accident in New York.

Our team is available to discuss the specifics of what happened and walk you through your possible next steps. You can reach Metro Law at (800) 469-6476 to learn more.
