Does Auto Insurance Cover Pedestrian Injuries in Bayville, NJ?Pedestrian Struck on Atlantic City Blvd in Bayville, NJ

In most cases, auto insurance can cover pedestrian injuries, but the specific coverage that applies depends on the circumstances of the crash. In New Jersey, the driver who struck the pedestrian may be held liable under their bodily injury liability coverage, which is designed to compensate people hurt by that driver's negligence. If the driver was uninsured or fled the scene, the pedestrian may be able to turn to their own auto insurance policy's uninsured motorist coverage, provided they carry it.

New Jersey's Safe Passing Law, which went into effect on March 1, 2022, requires drivers to approach and pass pedestrians and other vulnerable road users with "due caution", which means both slowing down and giving them adequate space. On single-lane roads, a minimum four-foot safety zone is required; if that space is not available, drivers must reduce speed to 25 mph and be prepared to stop.

Beyond liability coverage, New Jersey's no-fault system adds another layer. A pedestrian who owns a vehicle and carries a personal injury protection policy may be able to use their own PIP benefits to cover immediate medical expenses regardless of who was at fault. Those without their own policy may be able to access PIP through a resident relative's policy. A pedestrian accident lawyer can help determine which policies apply, in what order, and what documentation is needed to support a claim.
