How Do Lane Closures Affect Evidence in a Crash Claim in Wantagh, NY?Four-Car Crash Blocks Lane on Southern State Pkwy

When a crash blocks a lane and traffic is diverted for an extended period, it can actually help preserve important evidence for an injury claim. Longer response times usually mean more thorough documentation, including photos of vehicle positions, skid marks, and debris before the roadway is cleared. This kind of evidence can play a key role later when determining how a multi-vehicle crash happened.

New York follows a pure comparative negligence rule, in which an injured driver can recover damages even if they were partly at fault, though their recovery is reduced by their share of responsibility.

When multiple vehicles are involved, fault can be difficult to sort out, since more than one driver's actions may have contributed to the chain of events. Even minor injuries, such as whiplash or bruising, can still support a valid claim under New York law.

New York is also a no-fault insurance state, meaning a driver's own Personal Injury Protection (PIP) coverage typically pays initial medical bills regardless of who caused the crash. However, PIP has limits, and serious or lingering injuries may require pursuing a claim against an at-fault driver once those limits are reached.

In these cases, a car accident lawyer can help identify every liable party, request traffic camera or dashcam footage while it's still available, and determine how New York's no-fault and comparative negligence rules apply to a specific situation.
