Does Uninsured Motorist Coverage Apply in a Hit-and-Run in New Jersey?Pedestrian Hurt in Hit-and-Run Crash on NJ Turnpike Hudson Extension

Yes, in New Jersey, uninsured motorist (UM) coverage can apply when the driver who caused a crash flees the scene and cannot be identified. Because hit-and-run drivers are treated similarly to uninsured drivers under state law, your own UM coverage may help pay for medical expenses and other losses.

New Jersey law requires insurers to offer uninsured motorist coverage, though drivers can choose to reject it in writing. If you carry UM coverage, you may be able to file a claim with your own insurance company to recover compensation for medical bills, lost wages, and pain and suffering. However, there are specific steps and deadlines involved, and insurance companies do not always make the process straightforward.

Documenting everything early helps protect a potential claim. Medical records, police reports, and any available surveillance or toll camera footage from the Turnpike can all become important pieces of evidence. A Newark pedestrian accident attorney familiar with New Jersey hit-and-run cases can help gather that information and communicate with your insurance company on your behalf.
